EMPLOYMENT LAW

The employment law practice of Mr. Kennelly is wide ranging.  He has represented Plaintiffs in a wide variety of cases and his clients have been from all over the United States.  As a matter of course, Mr. Kennelly deals with the following areas:

  • Executive Contracts
  • Executive Separation Agreements
  • Age Discrimination
  • Race Discrimination
  • Gender Discrimination
  • Sexual Orientation Discrimination
  • Transgender Discrimination
  • Unpaid Overtime

  • Retaliation
  • Whistleblowing
  • Breach of Contract

On the management side Mr. Kennelly takes a business based approach to representing companies.  His style seeks preventive employee solutions.

His goal is to represent employers in an aggressive manner but to set a positive employee relations climate that minimizes litigation risk while insuring that employers do it right.  The best way to avoid litigation is to prevent it from being filed.

If you have any of these legal issues, feel free to contact our office.  A free phone consultation can be easily arranged.

MEDIATION EXPERIENCE

Dennis Kennelly has been representing Plaintiffs and Defendants in employment law and commercial disputes for over forty years.  This gives him a unique perspective in settling disputes since he understands not only the legal issues confronting the lawyers but the economic and emotional realities that both sides to a mediation bring with them to the process.

Mr. Kennelly’s style in mediation is engaging and personal.  He spots the roadblocks to resolution on both sides and gradually break through them to create the climate necessary to bring the matter to resolution.  His skills in his litigation practice allowed him to resolve well over 95% of his cases to a resolution before trial.  He uses the same skills and his wealth of experience to set the stage for resolution.  Anyone can shuttle between parties carrying settlement offers back and forth.  It is the rest of the process that creates an atmosphere where the numbers finally reach one upon which both sides can agree.  That is the art involved in the mediators role.

In his mediation process sometimes out of the box thinking is required to break a deadlock that is stalling the settlement  process.  His legal experience over four decades lets Mr. Kennelly come up with those often non-traditional solutions that are not in anyone’s playbook at the start of the day.    Mr. Kennelly will be happy to discuss all aspects of his process with counsel or the parties if further insight is required.

ENTERTAINMENT LAW

As a performing artist, contracts are always involved when you can turn your talents or creative product not money.  For the un-contracted, it is imperative to find out what situations require a written contract and what its content should be.

Similarly performing artists are often requested to sign documents that would affect their rights dramatically.  They need someone to explain what the effects of executing a contract means, be it a recording deal or a performance agreement.

Our office will help in these situations.  We will tell you when you need a written agreement and we will draft it for the client.  Additionally we will interpret any written agreement on artist is asked to sign and negotiate any changes that are appropriate.  Copyright Law is complicated.

There are a number of ways an artist can unknowingly put his or her creation into the public domain. Our office will guide the artist down the Copyright path as well.   We will gladly provide an artist a free phone consultation to address any issues.  This is the best way to prevent problems before they occur.

Unions play an important role in the entertainment industry. Dealing with union rules and union contracts is often complicated. Mr. Kennelly can help the artist navigate those often murky waters successfully.
